Welcome to Mark N Pick. These Terms of Service govern your use of https://www.marknpick.com and any purchase you make from us. By browsing our website, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use our store.

1. Account Terms

  • You must be at least 18 years old, or use the store under the supervision of a parent or guardian, to place an order.
  • You may browse and check out as a guest or create an account. When creating an account, you agree to provide accurate, current, and complete information.
  • You are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately at marknpick@gmail.com if you suspect unauthorized use.
  • We may suspend or close accounts that provide false information, violate these Terms, or are involved in fraud or abuse.

2. Pricing and Payment

  • All prices are listed in Pakistani Rupees (PKR) and are subject to change without notice. The price at the time you place your order is the price you pay.
  • Prices do not include applicable taxes. Shipping charges, if any, are shown at checkout before you confirm your order.
  • We accept the following payment methods: Cash on Delivery, JazzCash, Easypaisa, credit card, debit card.
  • Cash on Delivery (COD): Payment is due in full when your order is delivered. We may call or message you to confirm COD orders before dispatch. Orders that cannot be confirmed, or customers with repeated refused deliveries, may be cancelled or restricted from using COD.
  • Online or bank payments: Your order will be processed after payment is received and verified.
  • If we discover a pricing or listing error, we may cancel the affected order and refund any amount already paid.

3. Product Descriptions

  • We try to describe and photograph our products as accurately as possible, including colors, sizes, fabrics, and ingredients.
  • Because of screen settings, lighting, and photography, actual colors may differ slightly from what you see on your device. Minor variations in measurements, stitching, and fabric texture can occur with clothing.
  • For beauty products, please read the ingredient list before purchase. We are not responsible for allergic reactions caused by ingredients that are clearly listed. Do a patch test first if you have sensitive skin.
  • We do not guarantee that product descriptions or other content on the website are completely error-free. If a product you receive differs materially from its description, see Section 6.

4. Order Acceptance

  • Placing an order is an offer to purchase. It is not accepted until we send you an order confirmation (by email, SMS, or WhatsApp) and/or dispatch your order.
  • We reserve the right to refuse or cancel any order for reasons including product unavailability, pricing or listing errors, suspected fraud, inability to verify your details, or delivery restrictions.
  • If we cancel an order after payment, we will refund the full amount within 14 Business Days.
  • You may request to cancel or change an order before it is dispatched by contacting us at marknpick@gmail.com. We cannot guarantee changes once the order has shipped.

5. Shipping and Delivery

  • We deliver to addresses within Pakistan.
  • Orders are typically processed within 2 Business days and delivered within 7 Business days after dispatch. Delivery times are estimates and not guarantees. Delays may occur due to courier issues, weather, public holidays, sales periods, or events beyond our control.
  • You are responsible for providing a complete and correct delivery address and an active phone number. We are not liable for delays or failed deliveries caused by incorrect or incomplete details.
  • Please check your parcel at the time of delivery. If it is visibly damaged or tampered, do not accept it and notify us immediately.
  • Risk of loss passes to you once the order is delivered to the address you provided.

6. Returns and Refunds

  • Eligibility: You may request a return or exchange within 3 days of receiving your order if the item is unused, unwashed, in its original packaging with tags attached, and you have proof of purchase.
  • Defective, damaged, or wrong items: If you receive an item that is defective, damaged, or different from what you ordered, contact us within 3 days of delivery at marknpick@gmail.com with your order number and clear photos. We will offer a replacement, exchange, or refund at no extra cost to you.
  • Non-returnable items: For hygiene and safety reasons, opened or used beauty and personal care products, innerwear, customized items cannot be returned unless defective.
  • Refunds: Approved refunds will be issued within 14 Business days after we receive and inspect the returned item, using original payment method, bank transfer, or store credit. Original shipping charges are non-refundable except where the return is due to our error.
  • To start a return, contact us at marknpick@gmail.com. Please do not send items back without contacting us first.

7. Prohibited Uses

You agree not to use our website or services to:

  • Break any law or regulation of Pakistan or any applicable jurisdiction
  • Provide false, misleading, or fraudulent information, or place fake orders
  • Use stolen, unauthorized, or fraudulent payment methods
  • Attempt to gain unauthorized access to our website, servers, accounts, or other users’ data
  • Introduce viruses, bots, scrapers, or any malicious code, or interfere with the site’s operation
  • Copy, resell, or commercially exploit our content, images, or products without our written permission
  • Post abusive, defamatory, obscene, or unlawful content (including in reviews or messages)
  • Harass or threaten our staff or other customers

We may suspend or terminate access and report violations to the relevant authorities.

8. Intellectual Property

All content on this website, including the Mark N Pick name, logo, images, text, and design, belongs to us or our licensors and is protected by applicable intellectual property laws. You may not use, copy, or reproduce it without our prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Our website and products are provided on an “as is” and “as available” basis, and we do not guarantee uninterrupted or error-free access to the site.
  • Mark N Pick will not be liable for any indirect, incidental, special, or consequential losses or damages, including loss of profit, data, or opportunity, arising from your use of the website or products.
  • Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
  • We are not liable for delays or failures caused by events beyond our reasonable control, including courier delays, natural disasters, strikes, internet outages, or government actions.

Nothing in these Terms excludes or limits any liability or consumer right that cannot be excluded or limited under the applicable laws of Pakistan.

10. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date. Continued use of our website or placing an order after changes means you accept the updated Terms. Orders are governed by the Terms in effect at the time you place them.

11. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising from these Terms or your use of our store will be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan. We encourage you to contact us first so we can try to resolve any issue amicably.
